Job Overview:
The position of National Consultant is crucial for supporting the Ministry of Economic Development in Montenegro as it seeks to adopt amendments to the Bankruptcy Law. This role involves providing expert advice and consultancy services to ensure that the amendments are in line with international best practices and effectively address the needs of the local economy. The consultant will be expected to engage with various stakeholders, including government officials, legal experts, and business representatives, to facilitate discussions and gather insights that will inform the legislative process. The assignment is set to take place over a defined period, from June 5, 2026, to November 30, 2026, encompassing a total of 40 consultancy days. The consultant will play a pivotal role in drafting proposals, conducting research, and providing recommendations that will ultimately shape the final amendments to the law.

Duties and Responsibilities:
The National Consultant will be responsible for a range of duties including:
  • Conducting a comprehensive review of the current Bankruptcy Law and identifying areas that require amendments.
  • Engaging with stakeholders to gather input and feedback on proposed changes.
  • Drafting detailed reports and proposals outlining recommended amendments to the law.
  • Facilitating workshops and meetings with government officials and other stakeholders to discuss the proposed changes.
  • Providing expert advice on best practices in bankruptcy legislation from other jurisdictions.
  • Assisting in the preparation of necessary documentation for the legislative process.
  • Monitoring and evaluating the implementation of the amendments once adopted.
  • Ensuring that all recommendations are aligned with UNDP’s goals and objectives for sustainable development in Montenegro.

Required Qualifications:
Candidates must possess a strong background in law, particularly in bankruptcy and insolvency legislation. A proven track record of working with governmental bodies or international organizations on legal reforms is essential. Additionally, candidates should demonstrate excellent analytical and communication skills, with the ability to present complex legal concepts in a clear and concise manner. Familiarity with the economic context of Montenegro and the challenges faced by businesses in bankruptcy situations will be highly advantageous. Candidates should also have experience in stakeholder engagement and capacity building.

Educational Background:
A minimum of a Master’s degree in Law, Economics, or a related field is required. Candidates with a PhD or equivalent advanced qualifications in relevant areas will be preferred. Specialized training or certifications in bankruptcy law or insolvency practices will be considered an asset.

Experience:
The ideal candidate should have at least 5 years of professional experience in legal consultancy, particularly in the area of bankruptcy law. Experience working with governmental institutions or international organizations on legal reform projects is highly desirable. Proven experience in conducting stakeholder consultations and facilitating workshops will also be beneficial.

Languages:
Fluency in both English and Montenegrin is mandatory. Knowledge of additional languages, particularly those spoken in the Balkans, will be considered an advantage as it may facilitate communication with a broader range of stakeholders.

Additional Notes:
This consultancy position is part-time, with a total of 40 consultancy days spread over the assignment period. The consultant will be expected to work flexibly, coordinating with the Ministry of Economic Development and UNDP to meet project timelines. The position is open to both national and international candidates, and compensation will be commensurate with experience and qualifications.
