Job Overview:
The position of Consultant national pour la mise à jour de la législation sur la concurrence involves the development of a procedural manual for the Ministry of Commerce in Guinea. The consultant will be expected to engage in a comprehensive review of existing competition legislation and practices, identify gaps, and propose updates that align with international standards and best practices. The role requires a deep understanding of competition law and its implications for market dynamics in Guinea. The consultant will work closely with stakeholders, including government officials, to ensure that the new legislation is practical, enforceable, and beneficial for the economic environment of the country. The assignment is expected to last for 35 working days spread over 8 weeks, starting from December 29, 2025, and will require the consultant to be based in Guinea during this period.

Duties and Responsibilities:
The consultant will be responsible for the following duties and responsibilities:
  • Conduct a thorough analysis of the current competition legislation in Guinea, identifying strengths and weaknesses.
  • Engage with relevant stakeholders, including government officials, business representatives, and civil society, to gather insights and feedback on the existing legal framework.
  • Develop a comprehensive procedural manual that outlines the processes for enforcing competition laws, including guidelines for investigations, penalties, and appeals.
  • Ensure that the proposed updates to the legislation are in line with international best practices and tailored to the specific context of Guinea.
  • Prepare and present reports on findings and recommendations to the Ministry of Commerce and other relevant bodies.
  • Provide training and capacity-building sessions for government officials on the new competition legislation and its implementation.
  • Collaborate with UNDP and other partners to ensure the successful rollout of the updated legislation.

Required Qualifications:
The ideal candidate should possess the following qualifications:
  • A strong background in law, particularly in competition law or economic regulation.
  • Proven experience in legislative drafting or legal consultancy, preferably in the context of developing countries.
  • Familiarity with international competition law standards and practices.
  • Excellent analytical and research skills, with the ability to synthesize complex information into clear and actionable recommendations.
  • Strong communication and interpersonal skills, with the ability to engage effectively with a diverse range of stakeholders.

Educational Background:
Candidates must have at least a Master's degree in Law, Economics, or a related field. A specialization in competition law or regulatory affairs is highly desirable. Additional certifications or training in legislative drafting or public policy will be considered an asset.

Experience:
The position requires a minimum of 5 years of relevant professional experience in legal consultancy, particularly in the area of competition law. Experience working with government agencies or international organizations on similar projects will be an advantage. The candidate should demonstrate a track record of successfully managing similar assignments and delivering high-quality outputs within stipulated timelines.

Languages:
Fluency in French is mandatory, as the position requires communication with local stakeholders and the preparation of documents in French. Proficiency in English is considered an asset, as it may facilitate communication with international partners and access to additional resources.
