The Programme Office in Dushanbe focuses on supporting Tajikistan in its efforts to enhance security and cooperation in the region, particularly in areas such as governance, rule of law, and economic development.

Job Overview:
The National Legal Consultant will play a crucial role in the development of a bylaw that governs the preparation and execution of investment agreements in Tajikistan. This position requires close collaboration with the State Committee on Investments and State Property Management (SCISPM) to ensure that the bylaw aligns with national policies and international standards. The consultant will be responsible for drafting the bylaw over a period of 90 working days, which will take place from August to November. The consultant will need to familiarize themselves with the current legal framework surrounding investment policies in Tajikistan and assess the existing investment agreements to identify any gaps or issues that may hinder their execution. The ultimate goal is to create a transparent and predictable regulatory environment that encourages both domestic and foreign investments.

Duties and Responsibilities:
The successful candidate will be tasked with several key responsibilities, including:
  • Developing a comprehensive workplan and methodology for the assignment.
  • Familiarizing themselves with the current legal background of investment policy in Tajikistan by arranging meetings with SCISPM and its subordinate institutions.
  • Assessing the legal status of current investment agreements and identifying any omissions that may hinder their execution.
  • Developing a list of proposed mechanisms for monitoring and controlling the implementation of investment agreements.
  • Proposing tools for harmonizing national practices with international standards such as those set by OECD, UNCTAD, and IFC.
  • Suggesting necessary mechanisms to ensure coordination among government bodies and regulating their powers.
  • Proposing formalization procedures for reviewing investor proposals and defining requirements for investment agreements.
  • Suggesting improvements to government control procedures and introducing risk-oriented approaches.
  • Developing mechanisms to increase transparency in public administration and procurement processes related to investment agreements. 1
  • Preparing a draft of the bylaw and presenting it to SCISPM and POiD for review. 1
  • Revising the draft based on feedback from stakeholders and finalizing the bylaw and supporting documents.

Required Qualifications:
Candidates must possess a university degree in law, economics, business administration, commerce, finance, or a related field. Additionally, a minimum of 5 years of proven professional experience in legal advisory, investment, trade, finance, and commerce is required. Experience working with legal authorities, inter-governmental trade organizations, or business associations is essential. Candidates should have proven expertise in drafting legal documents that support strategic action plans and task force activities. Knowledge of risk assessment methods related to investment agreements is also necessary. Candidates must demonstrate gender awareness and sensitivity, and the ability to work with diverse teams while maintaining impartiality and objectivity. Computer literacy, particularly in Microsoft applications, is required.

Educational Background:
The position requires a Bachelor's Degree, which is defined as a first-level university degree or its equivalent in a relevant field such as law, economics, or business administration. This educational background is essential for understanding the complexities of investment agreements and the legal frameworks that govern them.

Experience:
The ideal candidate should have at least 5 years of relevant professional experience. This experience should include work in legal advisory roles, particularly in the context of investment, trade, finance, and commerce. Familiarity with the legal landscape in Tajikistan and experience working with governmental or inter-governmental organizations will be highly advantageous.

Languages:
Professional fluency in Tajik and Russian is mandatory for this position. Knowledge of English, both spoken and written, is considered an advantage, as it may facilitate communication with international stakeholders and enhance the consultant's ability to draft documents that meet international standards.
