The consultant is expected to produce a final report that includes a detailed legal assessment, recommendations for legal frameworks, and an action plan for integrating data protection principles into border management systems.
Duties and Responsibilities:
Conduct a legal assessment of the policy and legal framework governing border management between Mozambique and Malawi, focusing on mobility, trade facilitation, data management, and data protection.
Analyze the legal aspects governing the mobility of small-scale traders and their goods, including tax exemptions.
Identify the roles and responsibilities of border entities involved in the movement of persons, goods, and data across borders.
If necessary, recommend the development of a comprehensive legal and policy framework for border management, trade, and mobility.
Provide legal and data protection recommendations for the development of Standard Operating Procedures (SOPs) related to data exchange between the mobile border pass and MIDAS.
Create an action plan for integrating data protection principles into border management information systems.
Establish an assessment coordination-team" style="border-bottom: 1px dotted #007bff !important;">coordination team and develop a detailed work plan for the assessment process.
Design a methodology for the assessment and conduct a desk review of relevant frameworks.
Engage a junior partner from each country to ensure national context is considered. 1
Organize a workshop with stakeholders to present findings and recommendations. 1
Prepare and submit a final report that includes an analysis of legal identity documentation among border communities and recommendations for operationalizing the bilateral agreement.
Required Qualifications:
At least five years of legal practice with experience in law" style="border-bottom: 1px dotted #007bff !important;">international law, including institutional law and administrative law of international organizations.
Knowledge of local and international laws regarding the treatment of migrants in cross-border areas.
Experience in analyzing legal instruments and drafting legal documents related to borders and human mobility.
Familiarity with World Bank projects and protocols.
At least ten years of proven experience in providing legal advice and assessments to governments.
Proven experience in engaging with government stakeholders and facilitating meetings to draft and review documents.
Understanding of the governmental structure, political system, and legislation of Mozambique and Malawi.
Proven knowledge of the correlations between migration and trade.
Educational Background: A Master's degree in international law or Political Science from an accredited academic institution is required for this position. This educational background is essential to ensure the consultant has the necessary theoretical and practical knowledge to conduct the legal assessment effectively.
Experience: The position requires at least ten years of proven experience in legal practice, particularly in providing legal advice and assessments to governments.
