Job Overview: The National Consultant on Legal and Institutional Analysis and Environmental Governance will play a crucial role in providing a clear legal baseline and priority reform options for Mongolia's mining and mineral processing sectors. This position involves conducting a comprehensive legal analysis to support government-led legislative reform processes, ensuring that the outputs align with national priorities and international environmental governance standards. The consultant will work closely with the Ministry of Mining and Heavy Industry (MMHI) to develop practical options for green mining eligibility and screening criteria, contributing to the overall goal of enhancing environmental governance and promoting sustainable practices within the mining sector. The consultancy is expected to last for 8 months and will require part-time commitment, with specific tasks outlined to ensure effective delivery of outputs that meet quality standards and can be directly utilized by the government.
Duties and Responsibilities: The consultant will be responsible for several key outputs, including: 1) Preparing an inception report that outlines the methodology, workplan, and coordination arrangements with the international consultant. 2) Reviewing existing legislation and policy frameworks related to mining and mineral processing, focusing on environmental and social safeguards. 3) Conducting a legal and institutional gap analysis to identify inconsistencies and priority reform needs. 4) Developing recommendations for MMHI's legislative reform processes, ensuring alignment with UNEP's objectives. 5) Preparing a legal feasibility input note assessing Mongolia's legislative framework for green mining. 6) Organizing a consultative workshop to present findings and gather feedback from stakeholders. 7) Presenting revised findings and recommendations to UNEP and MMHI, ensuring stakeholder feedback is incorporated into the final outputs. The consultant will also be expected to provide advisory and analytical inputs throughout the drafting processes, maintaining a focus on environmental governance and legal coherence.
Required Qualifications: Candidates must possess an advanced university degree in law, environmental law, natural resources law, public law, or a closely related field. A minimum of five years of relevant professional experience in legal analysis, legislative review, or regulatory reform in Mongolia or comparable jurisdictions is required. Demonstrated knowledge of Mongolia's legislative and institutional framework, particularly in mining and environmental governance, is essential. Experience in supporting government-facing legal assessments and preparing analytical recommendations for reform processes is also required. Familiarity with issues related to mining governance, industrial policy interfaces, and environmental rule of law is desirable, as is knowledge of green finance eligibility criteria for the mining sector. Proven ability to consult effectively with public institutions and synthesize technical inputs into concise advisory outputs is also necessary.
